⚠️ Tip: Always confirm title language. “Tenants in common” does not avoid probate.
2. Name Beneficiaries on Accounts (TOD/POD Designations)
Assets with a named beneficiary skip probate and go directly to the named person.
Applies to:
- Life insurance
- IRAs and 401(k)s
- Bank accounts (via POD – Payable on Death)
- Investment accounts (via TOD – Transfer on Death)
✅ These designations override a will, so keep them current.
3. Create a Revocable Living Trust
Assets placed in a revocable trust during your lifetime:
- Are controlled by you (as trustee)
- Pass directly to beneficiaries upon death
- Do not go through probate
