The Probate Court Is in the County Where the Person Lived
In Pennsylvania, probate matters are handled by the Register of Wills and the Orphans’ Court Division of the Court of Common Pleas.
You file the probate case in the county where the person who passed away lived at the time of their death — also called their county of domicile.
Example:
- If your loved one lived in Wayne County, you file probate in the Wayne County Register of Wills.
- If they lived in Lackawanna County, you file in Lackawanna County — and so on.
Each Pennsylvania county has its own courthouse and Register of Wills office. This is where you submit the will (if there is one), get appointed as executor or administrator, and begin the probate process.
What If They Owned Property in Another County?
Even if the person owned property in multiple counties, you only file probate in the county where they lived. Out-of-county or out-of-state property can still be handled once the estate is opened.
What If You’re Not Sure Where They Lived?
This happens sometimes — especially if the person moved late in life, stayed with relatives, or was in a care facility. If you’re unsure:
- Look at their last driver’s license
- Check where they were registered to vote
- Review their most recent utility bills or bank statements
