Deadly Route 6 Crash in Palmyra Township

A fatal motorcycle accident occurred Friday evening in Palmyra Township in Pike County, leaving a 40-year-old man dead at the scene.

According to the Pennsylvania State Police, the crash happened around 7:30 p.m. on Route 6. A small truck was pulling out of a parking lot when it entered the path of a westbound motorcycle traveling at a high rate of speed.

The collision caused the motorcyclist to be ejected. Authorities have indicated that speed was a contributing factor, and alcohol use is suspected, though toxicology results are still pending. The investigation remains ongoing.

Understanding Right-of-Way in Pennsylvania

One of the most important legal questions in this type of crash is who had the right-of-way.

In Pennsylvania, drivers entering a roadway from a parking lot or private drive must yield to traffic already on the road. Failure to do so can result in liability—even if the other vehicle was traveling at a high rate of speed.

However, that is only part of the analysis. If a motorcyclist is speeding or impaired, that can reduce or even bar recovery depending on how fault is allocated.

Comparative Negligence: How Fault Is Shared

Pennsylvania follows a modified comparative negligence rule. That means:

  • A party can recover damages only if they are less than 51% at fault
  • Any recovery is reduced by their percentage of fault

So in a case like this, even if the motorcyclist was speeding, the driver of the truck could still share responsibility if she failed to safely enter the roadway.

These are not simple determinations—they require accident reconstruction, expert testimony, and a deep understanding of traffic laws.

Key Evidence in Motorcycle Crash Cases

To determine what really happened, several types of evidence become critical:

  • Crash scene analysis and skid marks
  • Vehicle damage patterns
  • Surveillance or nearby business footage
  • Witness statements
  • Toxicology reports
  • Black box or vehicle data (if available)

The sooner this evidence is preserved, the stronger the case becomes.
